Terms Summary
These Terms set the rules for using Specular and form the agreement between you and Carlos Eduardo Mauleón Castañón, the developer of the app. Specular is licensed for personal, non-commercial use, and your workout data, notes, and other content remain yours.
The Terms also cover subscriptions and App Store billing, workout sharing links, your responsibilities when using the app, third-party services, acceptable use, updates, suspension, and support. Specular is a fitness and training tool, not a medical device or source of medical advice. The Terms also explain warranty and liability limits while preserving any consumer rights that cannot legally be waived.
These Terms of Service ("Terms") govern your use of Specular: Workout Tracker ("the app"), and form an agreement between you and Carlos Eduardo Mauleón Castañón ("we," "us," "our"), an individual based in México. By downloading, installing, or using Specular, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the app.
Eligibility
You may use Specular only if you are legally capable of entering into a binding agreement under the law that applies to you.
License
Specular is licensed, not sold. We grant you a limited, non-exclusive, non-transferable, revocable license to install and use Specular on Apple devices you own or control, for your personal, non-commercial use, in accordance with these Terms and Apple's usage rules.
You may not:
- copy, distribute, sell, rent, lease, or sublicense Specular;
- reverse-engineer, decompile, disassemble, or attempt to extract source code, except where applicable law expressly permits it;
- bypass, disable, or interfere with any security or access control in the app;
- use Specular for any unlawful, harmful, fraudulent, or abusive purpose.
We retain all right, title, and interest in Specular and its underlying code, design, and content.
What Specular is (and is not)
Specular is a personal fitness and training-tracking tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Training load, recovery, and suggestion features are informational estimates based on the data you provide and your Apple Health history; they are not a substitute for professional medical or fitness guidance.
Consult a physician before beginning any new exercise program, particularly if you have an existing health condition. You are solely responsible for your own physical safety and for judging whether any workout, suggestion, or exertion level shown in the app is appropriate for you. Physical exercise carries an inherent risk of injury, and you assume that risk when you use Specular.
No guaranteed outcomes
We aim for Specular to be accurate and useful, but we do not guarantee it will be error-free, uninterrupted, or suitable for every person's training needs. Individual results vary, and we do not promise any specific fitness, performance, or health outcome.
Your responsibilities
You are responsible for the security of your device and Apple ID, for keeping your iOS version and the app reasonably up to date, and for the accuracy of any data you manually enter.
Subscriptions
Specular offers two auto-renewing subscription options, monthly and yearly, at the price and billing period shown on the in-app paywall at the time of purchase. Specular does not currently offer a free trial. Eligible Specular Pro subscriptions may be available through Apple's Family Sharing where supported by the subscription and Apple's current rules.
The yearly subscription may be offered at a discounted introductory price for new subscribers, for a limited time. Introductory pricing applies only to the first year of a yearly subscription; unless canceled, it renews afterward at the standard yearly price shown on the paywall. We may change or discontinue this offer at any time.
- Payment is charged to your Apple ID account upon confirmation of purchase.
- Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
- You can manage or cancel your subscription in Specular through Profile → Specular Pro → Manage Subscription, which directs you to Apple's subscription management system.
- Deleting the app does not, by itself, cancel an active subscription.
- Eligible purchases can be restored using the restore-purchase option provided by Specular and Apple's purchase system.
- Refunds are handled by Apple under Apple's own refund policies; we cannot issue refunds directly.
- We may change subscription prices or billing terms for future renewal periods. Where required, Apple will provide the applicable notice and obtain any required consent before a price change takes effect.
Your content
Workout data, notes, and story images you create in Specular remain yours. We don't claim ownership over your content. Most of this content remains on your device, but when you choose to create a workout share link, the workout data and display name included in the shared workout are uploaded to and stored by the sharing service so the link can retrieve them.
Workout sharing
Specular may allow you to create a shareable link for a workout. When you choose to share a workout, the workout data included in the share and your display name are uploaded to the sharing service so the link can retrieve the shared workout.
Anyone who has the share link may access the shared workout. You are responsible for deciding what workout information you share and who receives the link. Do not share information through a link if you do not want the recipient of the link to be able to access it.
Specular does not guarantee that a shared link will remain available indefinitely or that the sharing service will always be available. Share data does not currently have an automatic expiration or a user-facing deletion control in Specular.
You agree not to use workout sharing to publish content that is illegal, infringing, harassing, hateful, sexually explicit, or otherwise objectionable. We may remove a shared workout and may suspend or terminate your access to the sharing feature, without notice, if we believe it violates these Terms. To report a shared workout, send the link to hello@specularlabs.app; we will review it and remove it if it violates these Terms.
Acceptable use
Don't use Specular to violate any law, publish or share content that is illegal, infringing, harassing, hateful, or sexually explicit, or attempt to disrupt its normal operation.
Third-party services
Specular relies on third-party services to provide certain features. RevenueCat is used to manage subscription status and entitlements. Apple provides the App Store purchase system, HealthKit, Maps services, and the Photos framework used when you choose to save a workout story to your Photos library. Specular uses Photos for that save action and does not need access to your existing photo library for this feature. Cloudflare provides the website hosting and workout-sharing infrastructure used when you create a share link. Your use of these services may also be subject to Apple's applicable terms and policies and, where applicable, RevenueCat's and Cloudflare's terms.
Support
We, and not Apple, are responsible for providing support for Specular. If you have questions, complaints, or claims, contact us using the details below.
Additional App Store terms
If you downloaded Specular from Apple's App Store, you acknowledge and agree that:
- these Terms are between you and us only, and not between you and Apple;
- Apple has no obligation to provide maintenance or support services for Specular;
- if Specular fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, paid for Specular; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to Specular;
- we, and not Apple, are responsible for addressing any claims by you or a third party relating to Specular, including product liability claims and claims arising under consumer protection law;
- we, and not Apple, are responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim relating to Specular;
- you represent that you are not located in a country subject to a U.S. government embargo, and are not on any U.S. government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Updates and changes to Specular
We may release patches, bug fixes, or new versions of Specular, and may change, add, or discontinue features for reasons including security, legal compliance, technical requirements, or product improvement. Some future features may require additional permissions or a different permission level than the current version. If an update changes a location permission requirement, we will notify users through the app or applicable update information before or when that change takes effect. We won't charge additional fees for ordinary updates unless we separately offer a new paid feature that you choose to purchase.
User content and feedback
You retain ownership of workout data, notes, story images, and other content you create in Specular. You grant us only the limited rights reasonably necessary to provide support when you voluntarily send information to us, such as through a support email. We do not claim ownership of your content or use it for advertising.
Suspension and termination
You may stop using Specular at any time by deleting the app. If you have an active subscription, cancel it through your App Store account settings; deleting the app does not cancel it. We may suspend or discontinue the app, or any feature, at our discretion, including where necessary for security, legal, or technical reasons.
Changes to these terms
We may update these Terms as the app changes. If we make material changes, we'll make reasonable efforts to notify you. Continued use after an update means you accept the revised Terms.
Mandatory consumer rights
Nothing in these Terms excludes, limits, or affects any mandatory rights you have under the consumer protection law of your country of residence, including any non-waivable rights relating to refunds, conformity of digital content, or termination.
Disclaimer of warranties
To the fullest extent permitted by applicable law, Specular is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Specular will always be available, secure, uninterrupted, or error-free.
Limitation of liability
To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data, goodwill, or business opportunity, arising from your use of Specular. Our total liability for any claim relating to Specular will not exceed the amount you paid us in the 12 months before the claim, to the fullest extent permitted by applicable law.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.
Governing law
These Terms are governed by the laws of the United Mexican States (México), without regard to conflict-of-law principles. If you are a consumer, this choice of law does not deprive you of any mandatory consumer protections available to you under the law of your own country of residence.
Severability and no waiver
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver of our right to do so later.
